Terms of Service

1. Acceptance of Terms

By accessing or using PolymarketV2 ("Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and PolymarketV2. Your use of the Platform is also governed by our Privacy Policy.

2. Eligibility

To use PolymarketV2, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be a resident of a Restricted Jurisdiction (see Section 3)
• Not be subject to any sanctions or restrictions that would prohibit your use
• Have a compatible cryptocurrency wallet

By using the Platform, you represent and warrant that you meet all eligibility requirements. We reserve the right to verify your eligibility at any time.

3. Geographic Restrictions

PolymarketV2 is NOT available in the following jurisdictions:

United States and Territories

United States of America, American Samoa, Guam, Northern Mariana Islands, Puerto Rico, U.S. Virgin Islands, and U.S. Minor Outlying Islands.

OFAC Sanctioned Countries

Iran, Cuba, North Korea, Syria, Russia, Belarus, Venezuela, and Crimea region.

Countries with Gambling Restrictions

United Kingdom, France, Belgium, Poland, Singapore, Australia, Taiwan, Thailand, and Ontario (Canada).

Other Restricted

Bolivia.

4. Permitted Jurisdictions

PolymarketV2 is available in most countries not listed above, including but not limited to:

Europe: Germany, Spain, Italy, Netherlands, Portugal, Sweden, Norway, Denmark, Austria, Switzerland, Ireland, Czech Republic, Greece, Finland, Hungary, Romania, and other EU countries not restricted.

Americas: Mexico, Brazil, Argentina, Colombia, Chile, Peru, Canada (except Ontario), and most Latin American countries.

Asia-Pacific: Japan, South Korea, India, Indonesia, Philippines, Vietnam, Malaysia, New Zealand, and other countries not restricted.

Middle East & Africa: UAE, Saudi Arabia, Qatar, Israel, Turkey, Nigeria, South Africa, Kenya, and other countries not restricted.

5. Nature of the Platform

PolymarketV2 is a decentralized prediction market platform built on the Solana blockchain. The Platform allows users to create and participate in prediction markets on various topics.

6. User Responsibilities

By using the Platform, you agree to:

• Provide accurate and truthful information
• Maintain the security of your wallet and private keys
• Comply with all applicable laws and regulations in your jurisdiction
• Not use the Platform for any illegal or unauthorized purpose
• Not attempt to manipulate markets or engage in fraudulent activity
• Not use automated bots or scripts without authorization
• Not harass, abuse, or harm other users
• Not create markets with misleading, defamatory, or illegal content

7. Market Resolution

Markets on PolymarketV2 are resolved by the market creator based on publicly verifiable information. While we strive for accurate resolutions:

• We do not guarantee the accuracy of any market resolution
• Disputes may arise and are handled on a case-by-case basis
• Resolution decisions, once finalized on the blockchain, are generally irreversible
• We reserve the right to cancel markets that violate our policies

8. Fees

PolymarketV2 charges fees on predictions placed on the Platform:

• Platform Fee: 4% of each prediction amount
• Market Creator Fee: 1% of each prediction amount
• Total Fee: 5% deducted at the time of prediction

Additionally, standard Solana network transaction fees apply. Fees are non-refundable.

9. Intellectual Property

The Platform, including its design, features, and content (excluding user-generated content), is owned by PolymarketV2 and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION
• SECURITY OF THE PLATFORM OR YOUR FUNDS
• RESULTS OBTAINED FROM USE OF THE PLATFORM

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HYPOMARKET AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• LOSS OF PROFITS, DATA, OR GOODWILL
• LOSS OF CRYPTOCURRENCY OR FUNDS
• SMART CONTRACT FAILURES OR VULNERABILITIES
• UNAUTHORIZED ACCESS TO YOUR WALLET
• MARKET MANIPULATION BY THIRD PARTIES
• INCORRECT MARKET RESOLUTIONS

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT OF FEES YOU PAID TO US IN THE PRECEDING 12 MONTHS.

12. Indemnification

You agree to indemnify, defend, and hold harmless PolymarketV2 and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws

13. Dispute Resolution & Governing Law

These Terms shall be governed by and construed in accordance with the laws of Panama, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Panama City, Panama, in accordance with the rules of the International Chamber of Commerce (ICC).

You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Platform ceases immediately
• Funds in active markets will be handled according to market rules or may be forfeited if termination was due to Terms violation
• Sections 10-13 (Disclaimers, Liability, Indemnification, Dispute Resolution) survive termination

15. Changes to Terms

We may modify these Terms at any time. Changes will be effective when posted on the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
